TERMS AND CONDITIONS

Important: The English version shall always prevail in case of any discrepancy or inconsistency between English version and its Malay and/or Chinese translation.

  1. NAME OF CAMPAIGN
    Vax to Win
  2. CAMPAIGN PERIOD

    1 July 2021 to 31 March 2022

    All entries received after the Campaign Period shall automatically be disqualified.

    8 May 2022
  5. CAMPAIGN MECHANISM
    1. Each participant must comply with the following to be eligible to participate in the Campaign:
      1. submit a copy of their vaccination digital certificate;
      2. answer the five (5) questions set by Aspen Group correctly; and
      3. submit a slogan in accordance with the requirements set out in clause 6 below.
    2. A ballot will be conducted on the Ballot Date by an appointed consulting firm, BDO GA Sdn Bhd (“BDO”) via a live broadcast on Aspen Group’s Facebook page to shortlist 28 participants who will be eligible for the Prizes.
    3. The slogans submitted by these 28 participants will be evaluated by a panel of judges in accordance with the Slogan Evaluation Criteria to determine the respective winners of the Grand prize, 1st – 3rd prize, 4th – 7th prize, and the consolation prizes.
    4. The winners of the respective prizes will be announced on the Winner Announcement Date via Aspen Group’s Facebook page and on www.vaxtowin.aspen.com.my.
    5. The decisions made in relation to the Campaign including the slogans are final and conclusive and shall not be subject to any appeal whatsoever.
  6. SLOGAN
    1. The slogan must be not more than 20 words and in English or Bahasa Malaysia.
    2. The theme of the slogan is in conjunction with our nation’s battle against COVID-19 as follows:

      “Emerging Stronger for our Nation”

    3. Each slogan will be evaluated based on the following criteria: (i) originality; (ii) creativity; (iii) use of language; and (iv) relevancy to the theme (“Slogan Evaluation Criteria”).
    4. By submitting the slogan, the participant represents, warrants and undertakes that:
      1. the slogan submitted does not contain anything illegal, pornographic, degrading, defamatory or abusive, in any manner whatsoever to any person or corporation; and
      2. the slogan is entirely their own work and that they are the legal and beneficial owner of any Intellectual Property Rights attached to the slogan submitted by them.
    5. By submitting the slogan, the participant grants Aspen Group, its authorised users, assigns and successors-in-title an exclusive, perpetual, royalty-free, irrevocable, worldwide, transferable and sub-licensable licence, for any purposes whatsoever, to exercise any and all Intellectual Property Rights in the slogans. Aspen Group reserves the rights to use any of the submitted slogans for its promotional and/or marketing material without any reference to the participant.
    6. In these Terms and Conditions, “Intellectual Property Rights” refers to trade marks, service marks, trade names, domain names, logos, get-up, patents, inventions, registered and unregistered design rights, copyrights, and all other similar rights in any part of the world including, without limitation, where such rights are obtained or enhanced by registration, any registration of such rights and applications and rights to apply for such registrations.
    7. Clauses 6(5) and (6) herein shall survive the termination of the Terms and Conditions including, the expiry of the Campaign Period.
  7. PRIZES

    There will be a total of 28 prizes:

    Grand prize:
    One (1) unit of Vertu Resort (including 1 tandem car park)

    1st – 3rd prize:
    One (1) unit of Vivo Executive Apartment (including 2 single car parks)

    4th – 7th prize:
    RM15,000 IKEA gift card

    20 Consolation prizes:
    RM10,000 IKEA gift card (x10) and RM5,000 IKEA gift card (x10)

    Aspen Group reserves the right to amend or substitute the Prizes at its sole discretion at any point during this Campaign Period up until the Winner Announcement Date.

  8. ELIGIBILITY

    This Campaign is open to all Malaysian citizens who are 18 years of age and above who have been fully vaccinated against COVID-19 by 31 March 2022, in Malaysia including Aspen Group employees, and Aspen Group’s appointed agencies only.

    For purposes of these Terms and Conditions, “fully vaccinated” shall mean either fourteen (14) days from the date the 2nd dose is administered for 2-dose vaccines, or twenty eight (28) days from the date of the administration of the vaccine for single dose vaccines, or such other period as may be determined by the Government of Malaysia.

  9. CAMPAIGN MECHANICS

    Balloting

    1. For new purchasers (including existing purchasers who have purchased new units):
      1. Purchase of any one (1) unit of Aspen Projects (excluding Tri Pinnacle Low Medium Cost units) between the period of 5 June 2021 to 31 March 2022.
        For the avoidance of doubt, “purchase” in these Terms and Conditions refer to the signing of the booking form.
      2. For Vervea, the purchase of each unit is entitled to 200 entries for the ballot, whereas for all other Aspen Projects (excluding Tri Pinnacle Low Medium Cost units), the purchase of each unit is entitled to 100 entries.
      3. If there is more than one (1) purchaser for the unit, only one (1) purchaser will be eligible to enter the Campaign for that particular unit.
      4. For each purchase, the following must be completed:
        1. the sale and purchase agreement must be executed and stamped; and
        2. if the purchaser is taking a loan, the loan letter of offer must be executed within 45 days from the date the booking form is signed or by 30 April 2022, whichever is earlier.
      5. The purchaser must be registered for vaccination under the National COVID-19 Immunisation Programme via MySejahtera upon the signing of the booking form and must be fully vaccinated in Malaysia under the said Immunisation Programme and in possession of their vaccination digital certificate by 31 March 2022.
    2. For existing purchasers of Aspen Projects (including Tri Pinnacle Low Medium Cost Units):
      1. Introduce purchasers who purchase at least one (1) unit of Vervea or for all other Aspen Projects (excluding Tri Pinnacle Low Medium Cost units), at least two (2) units of any of the Aspen Projects (excluding Tri Pinnacle Low Medium Cost units) between the period of 5 June 2021 to 31 March 2022.
      2. Only one (1) existing purchaser will be eligible to enter the campaign for each unit of Vervea or for every two (2) units of any other Aspen Projects (excluding Tri Pinnacle Low Medium Cost units) which are sold.
      3. For Vervea, the successful sale of each unit is entitled to 100 entries for the ballot, whereas for all other Aspen Projects (excluding Tri Pinnacle Low Medium Cost units), the successful sale of every two (2) units are entitled to 100 entries.
      4. For each purchase, the following must be completed:
        1. the sale and purchase agreement must be executed and stamped; and
        2. if the new purchaser is taking a loan, the loan letter of offer must be executed within 45 days from the date of the booking form is signed or by 30 April 2022, whichever is earlier.
      5. The existing purchaser must be registered for vaccination under the National COVID-19 Immunisation Programme via MySejahtera upon the signing of the booking form and must be fully vaccinated in Malaysia under the said Immunisation Programme and in possession of their vaccination digital certificate by 31 March 2022.
      6. The referrer and the new purchaser must both sign a letter of confirmation to confirm the referral in the form and format to be provided by Aspen Group, and such letter of confirmation must be submitted to an identified senior personnel of Aspen Group, whose details would be provided to them upon the purchase of the property.
    3. For Aspen Group employees:
      1. Subject to Aspen Group achieving its sales target between the period of 5 June 2021 to 31 March 2022, all employees of Aspen Group (including sales consultants) who have achieved their individual sales targets set by Aspen Group and all the related legal documents for the sales are completed within the stipulated timeframe will be entitled to participate in the Campaign. Every target milestone achieved by the employee will entitle the said employee to 100 entries for the ballot.
      2. In computing the said sales target, the following must be completed for each purchase:
        1. the sale and purchase agreement must be executed and stamped; and
        2. if the purchaser is taking a loan, the loan letter of offer must be executed within 45 days from the date the booking form is signed or by 30 April 2022, whichever is earlier.
      3. The employee must be registered for vaccination under the National COVID-19 Immunisation Programme via MySejahtera and fully vaccinated in Malaysia under the said Immunisation Programme and in possession of their vaccination digital certificate by 31 March 2022.
    4. For individual agents:
      1. Any agent who has achieved their sales target set by Aspen Group under their personal performance will be entitled to participate in the campaign. Every target milestone achieved by the agent will entitle the said agent to 100 for the ballot.
      2. In computing the said sales target, the following must be completed for each purchase:
        1. the sale and purchase agreement must be executed and stamped; and
        2. if the purchaser is taking a loan, the loan letter of offer must be executed within 45 days from the date the booking form is signed or by 30 April 2022, whichever is earlier.
      3. The agent must be registered for vaccination under the National COVID-19 Immunisation Programme via MySejahtera and fully vaccinated in Malaysia under the said Immunisation Programme and in possession of their vaccination digital certificate by 31 March 2022.
    5. For appointed agencies:
      1. Any agency who has achieved their sales target set by Aspen Group, will be entitled to participate in the campaign. Every target milestone achieved by the agency will entitle the said agency to 100 entries for the ballot.
      2. In computing the said sales target, the following must be completed for each purchase:
        1. the sale and purchase agreement must be executed and stamped; and
        2. if the purchaser is taking a loan, the loan letter of offer must be executed within 45 days from the date the booking form is signed or by 30 April 2022, whichever is earlier.
      3. All the directors of the said agency must be registered for vaccination under the National COVID-19 Immunisation Programme via MySejahtera and fully vaccinated in Malaysia under the said Immunisation Programme and in possession of their vaccination digital certificate by 31 March 2022.
    6. For the general public:
      1. Any Malaysian citizen who is registered for vaccination under the National COVID-19 Immunisation Programme via MySejahtera and has been fully vaccinated in Malaysia under the said Immunisation Programme and in possession of their vaccination digital certificate on or before 31 March 2022 will be entitled to 1 entry.
      2. Any individual who has participated in the campaign under the above categories 9(1) – (4) are not eligible to participate under the category for the general public.
    7. Slogan Evaluation

    8. Each participant submitting an entry must complete a Slogan which complies with the Slogan Criteria. Each participant need only submit ONE Slogan irrespective of the number of balloting entries he/she/they are entitled to.
    9. Slogans submitted will be assessed in accordance with the Slogan Evaluation Criteria in accordance with the following: (i) originality (30 points); (ii) creativity (20 points); (iii) use of language (20 points); and (iv) relevancy to the theme (30 points).
    10. General

    11. In respect of Items 9(1) – (5) herein, if the sale and purchase agreement between the purchaser and the developer is terminated or rescinded for any reason whatsoever at any point before the Ballot Date, the transaction shall not be considered as a successful sale for the purposes of calculation of the number of entries the participant is entitled to for the ballot.
    12. Notwithstanding the aforementioned, Aspen Group shall have the absolute discretion to grant any waivers or indulgence of the terms and conditions of eligibility.
    13. The winners of the Campaign will be informed of their winning through their last known contact details made available to Aspen Group.
    14. The winners are required to present and redeem their prizes at a venue and time which will be informed to the winners. In the event any of the prizes are withdrawn for any reason whatsoever, Aspen Group reserves the right to deal with the withdrawn prize(s) in such manner as it deems fit at its absolute discretion and will not entertain any dispute or appeal of any kind from any winners.
    15. Aspen Group shall be entitled to request to sight and/or request for a copy of the following:
      1. the vaccination page on the participant’s MySejahtera App for proof of registration for vaccination under the nationwide vaccination programme;
      2. the digital certificate issued as proof that the participant has been fully vaccinated in Malaysia;
      3. the original identity card and/or the original of the other supporting documents and/or such other relevant documents and/or information in relation to the participant(s) or winner(s) or the winner’s nominee collecting the prize on behalf of the winner (“Identification Document”);
      4. the Identification Document of the winner(s)’s nominee(s), for the purposes of verification and redemption of Prize;
      5. a valid letter of authorisation by the winner nominating the nominee providing the nominee’s identification details (if collecting the prize on behalf of the winner);
      6. if there is more than one (1) purchaser / introducer for one (1) unit, a letter of authorisation from all the purchaser(s) / introducer(s) nominating one (1) purchaser / introducer to enter the Campaign; and
      7. any other documents required by Aspen Group.

      Aspen Group reserves the right to verify any such documents submitted by the participants before approving the participants’ application to join the Campaign.

    16. Aspen Group reserves the right to reject/disqualify/disallow any entry or forfeit/withdraw any Prize at its sole discretion if:
      1. the participant or winner fails to provide any Identification Document and/or any other documentary proof requested by Aspen Group pursuant to clause 9(13) herein; and/or
      2. Aspen Group has reason to believe that there is any attempt by the participant to compromise the integrity of the Campaign by hacking, cheating or committing fraud or manipulation in any way, including but not limited to providing false details or information or forged documents.
    17. Each participant may be entitled to multiple entries in accordance with the terms and conditions herein but each participant shall be entitled one (1) Prize only. Once the participant’s name has been drawn in the ballot, any subsequent drawing of the same name will be deemed ineligible.
    18. The Prizes are not transferrable or exchangeable for cash or otherwise. In the event the participant is unable to collect their Prize, they may elect to nominate a representative to receive and/or collect the prize on their behalf.
    19. Aspen Group accepts no responsibility for any tax (including but not limited to real property gains tax) or other liability or costs incurred that may arise from the prize winnings (including but not limited to the legal fees, stamp duty, state consent fee or other disbursements that may be incurred to effectuate the prize winnings).
    20. Aspen Group shall be under no obligation to replace any of the Prizes (such as IKEA Gift Cards) that are not utilised by the winners before any expiry date.
  10. SOCIAL MEDIA REQUIREMENT
    In participating in this Campaign, you agree that:

    1. Aspen Group reserves its absolute rights to request for a digitally recorded session (including but not limited to photo-shooting and video-shooting) with such participant(s) for the purposes of verifying statements, advertising, broadcasting, and/or otherwise wherein the consent of the participant(s) shall not be unreasonably withheld or refused;
    2. you give consent to Aspen Group to tag you in their post(s) on its social media platforms, including its official Facebook page (www.facebook.com/myaspen group), Facebook event page (if any), its official Instagram page (www.instagram.com/aspengroup.my/); and
    3. such other requirement(s) as may be required by Aspen Group for the purposes of marketing, advertising or broadcasting from time to time; and
    4. all photos and the entire recorded video footage developed by Aspen Group shall remain the sole property of Aspen Group and may be used by Aspen Group, its affiliates or partners for purposes of marketing and promotions.
  11. INDEMNITY
    By participating in the Campaign, you agree to fully indemnify and keep Aspen Group indemnified in full from any and all claims, damages, losses, demands, causes of action, proceedings, expenses, and/or liabilities resulting or arising out of or in connection with, claimed to have arisen, resulted from or be connected with any misrepresentation, wrongful act and/or breach of the terms and conditions herein.
  12. DISCLAIMER & LIMITATION OF LIABILITY

    By participating in the Campaign, you understand and agree that your participation is at your own risk and that Aspen Group is not liable to any person whether in tort, contract, statute, or otherwise for any direct, indirect, incidental or consequential damages or costs in connection with your participation in the Campaign.

    Aspen Group makes no representation or warranty whatsoever pertaining to the continuous, uninterrupted and error-free operation of the Campaign.

    Accordingly, you agree and undertake to release and hold harmless Aspen Group and its subsidiaries, affiliates, sponsors, partners, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim or damage, directly or indirectly, whether caused by negligence or not, arising out of or resulting from or in any manner connected to that participant’s participation in the Campaign.

  13. PERSONAL DATA PROTECTION ACT
    1. Entry and participation in the Campaign shall be deemed an unconditional acceptance by the each participant of the use of any and all personal data disclosed in relation to that participant, including but not limited to the participant’s COVID-19 vaccination status, and that participant further shall be deemed to have read and accepted the terms and conditions of our Personal Data Protection Notice on Aspen Group’s official website at https://aspen.com.my/wp-content/themes/html5blanktable/assets/pdf/PERSONAL%20DATA%20PROTECTION%20NOTICE.pdf.
    2. All personal data collected during the Campaign and maintained by Aspen Group are done in accordance with the Personal Data Protection Act 2010.
    3. Unless informed otherwise, Aspen Group reserves the right to send current and future promotional materials and to contact the participants for sales and marketing purposes based on the personal data disclosed.

    4. Aspen Group reserves the rights to publish personal data, photo(s) and/or any other digitally recorded footage of the participant(s) for promotional or publicity purposes and without prior notice to the participant(s).
  14. OTHER TERMS & CONDITIONS
    1. The Campaign and all information published and related to it are intellectual property rights belonging to Aspen Group and remain the sole property of Aspen Group.
    2. All references to the plural herein shall mean the singular and to the singular shall also mean the plural, vice versa.
    3. Aspen Group reserves the right to add, amend, vary, and/or remove any of the terms and conditions herein, or at its discretion, to discontinue the Campaign without disclosing any reason and without prior notice.
    4. The decision of Aspen Group is final and conclusive, no appeal and/or correspondence will be entertained.
    5. All rights not specifically and expressly granted in this terms and conditions are reserved by Aspen Group.
    6. This instrument is governed by and construed in all aspects in accordance with the laws of Malaysia.
    7. Aspen Group shall not be liable for any default in respect of the Campaign due to any act of God, war, riot, strike, lockout, industrial action, fire, flood, storm, technical or system failures, pandemic (including any imposition by the Government of Malaysia in relation thereto), or any other event beyond the reasonable control of Aspen Group.
